1. Introduction

Welcome to Truevail, an all-in-one platform providing automated and customizable digital marketing solutions for luxury travel advisors. By accessing or using our services at https://truevail.com and https://truevailapp.com, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please refrain from using our services.

2. Services

Truevail offers digital marketing services that include, but are not limited to:

Email Campaign Management: Customizable and done-for-you email newsletters.

Social Media Management: Social media posts, Reels, and videos, including scheduling and automation.

Content Libraries: Access to Truevail’s pre-built templates, branded content, and industry insights.

Website Design and Setup: Beautiful, SEO-optimized websites created specifically for travel advisors, with a focus on user experience and luxury branding.

DIY and Done-For-You Options: Flexible options for either full control or automated services with minimal user setup.

Truevail’s services are designed exclusively for travel advisors and related industry professionals. Any content, tools, or materials provided by Truevail are intended solely for business use within the travel advisory field.

3. Account Registration

When creating an account with Truevail, you agree to:

-Provide accurate and complete information.

-Maintain the confidentiality of your login credentials.

-Notify Truevail immediately of any unauthorized use of your account.

-Truevail reserves the right to suspend or terminate your account if we suspect any unauthorized or unlawful activity.

4. Subscription and Billing

Truevail operates on a subscription-based model. You agree to pay all applicable subscription fees according to the plan you select during registration. Unless otherwise stated, all fees are billed monthly in advance and are non-refundable.

If Truevail introduces new services or features that incur additional fees, you will be notified in advance and given the option to opt-in.

5. User Content and Responsibilities

As a Truevail user, you may submit content for use within newsletters, social media posts, or other materials generated on the platform. You are solely responsible for the accuracy, legality, and appropriateness of any content you provide. By submitting content, you grant Truevail a non-exclusive, royalty-free license to use, reproduce, and display your content within the platform.

You are also responsible for verifying the accuracy and suitability of all content sent to your audience through the Truevail platform.

6. User Database and Data Security

Truevail takes the privacy and security of your user database seriously. Your customer lists and associated data are stored securely and are not used by Truevail for any purpose beyond providing our services to you. Truevail will not share, sell, or use your database information for any marketing or other external purposes. Truevail complies with applicable data protection laws, including but not limited to GDPR and CCPA, in the handling and storage of user data.

7. Platform Security and Account Integrations

Truevail utilizes secure integrations to manage access to third-party platforms such as social media accounts. Truevail does not store or have direct access to your account passwords. Connections to third-party services, such as social media platforms, are made via secure API integrations to protect your accounts and personal information. You are responsible for maintaining the security of your login credentials with third-party platforms, and Truevail disclaims any liability for unauthorized access or security breaches that occur outside our platform.

8. Intellectual Property and Use of Licensed Content

All content provided by Truevail—including templates, branded materials, guides, and licensed stock photos—is the property of Truevail or its licensors and is protected by intellectual property laws. Truevail grants you a limited, non-exclusive, revocable license to use this content solely within the Truevail platform for marketing purposes.

Stock Photos: Licensed stock photos provided within Truevail are restricted to platform-exclusive use. You are prohibited from downloading, reproducing, distributing, or using these photos outside of Truevail-generated content.

Any attempt to misuse, reproduce, or distribute Truevail’s content or licensed images outside the permitted scope will be considered a breach of these Terms and may lead to account suspension, termination, or legal action.

9. DIY and Done-For-You Content

Truevail offers both customizable DIY options and Done-For-You services. When using the Done-For-You service, you acknowledge that:

Content is provided as-is and intended for Truevail’s platform. Truevail does not guarantee compatibility with other platforms or websites.

Content customization is limited to the scope of the platform’s capabilities and the selected service package.

DIY content created on Truevail’s platform remains subject to these Terms, and Truevail retains the right to review and remove any content that may violate intellectual property laws, other users’ rights, or applicable regulations.

10. Privacy and Data Usage

Your use of Truevail is also governed by our Privacy Policy. We are committed to protecting your data and only collecting the necessary information to provide our services. Any data provided is used in accordance with our Privacy Policy, which you agree to upon signing up.

11. No Guarantee of Results or ROI

Truevail does not guarantee any specific results or return on investment (ROI) from using our services. Marketing outcomes can vary widely and are influenced by numerous factors beyond Truevail’s control. You acknowledge that Truevail is not responsible for any financial or business outcomes resulting from your use of the platform.

12. Limitation of Liability for Content and Technical Issues

To the fullest extent permitted by law, Truevail shall not be liable for any damages or losses resulting from:

Misinformation: Any inaccuracies or outdated information in content provided through Truevail.

Technical Issues: Interruptions, delays, or malfunctions in the platform.

Reputational Harm: Any impact on your business’s reputation resulting from content, social media posts, email campaigns, or other materials generated on Truevail.

Client Loss or Damages: Any indirect, incidental, special, or consequential damages arising out of or related to the use or inability to use our services.

Our liability, if any, is limited to the amount you paid for your subscription during the three months preceding any claim.

13. Indemnification

You agree to indemnify and hold harmless Truevail, its affiliates, employees, and agents from any claims, damages, liabilities, or expenses arising from your use of our platform, including any third-party claims of copyright infringement or misuse of content.

14. Platform Availability

Truevail strives to maintain high availability of our platform. However, we may occasionally perform scheduled maintenance or experience unforeseen technical issues. You acknowledge that Truevail is not liable for any interruptions, delays, or disruptions in service and that Truevail reserves the right to modify, suspend, or discontinue any part of the service temporarily or permanently.

15. Use of Third-Party Integrations

Truevail may integrate with third-party platforms or services (e.g., social media channels). You acknowledge that your interactions with these third-party services are subject to the terms and conditions of those services. Truevail assumes no responsibility for any issues arising from such third-party integrations.

16. Dispute Resolution

In the event of a dispute between you and Truevail, both parties agree to first attempt to resolve the dispute informally. If an informal resolution cannot be reached, both parties agree to submit the dispute to binding arbitration as the primary means of resolving the conflict, subject to the rules and procedures of the American Arbitration Association. This agreement to arbitrate does not preclude either party from seeking injunctive relief in a court of competent jurisdiction.

17. Changes to Terms and Services

Truevail reserves the right to modify these Terms and our services at any time. We will provide notice of any significant changes by posting the latest version of these Terms on our website or notifying you through email or platform notifications. Your continued use of Truevail following any changes constitutes acceptance of the modified Terms.

These Terms are governed by and construed in accordance with the laws of Florida, USA, where Truevail is registered.
